GONE FOR A RUN (“GFAR”)/CHALKTALK SPORTS, INC. (“CTS") VIRTUAL RACE AGREEMENT AND LIABILITY WAIVER
PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
By registering for this virtual event (the “Event”), you acknowledge that you have read, understand, and agree to the terms below.
1. Virtual Event Acknowledgment
You understand that this is a virtual event and that you are solely responsible for choosing the location, route, timing, and conditions under which you participate. Gone for a Run does not supervise, monitor, or control your participation.
2. Assumption of Risk
You acknowledge that participation in the Event is physically demanding and may involve risks including, but not limited to, discomfort, illness, injury, permanent disability, or death.
You voluntarily assume all risks, known and unknown, associated with your participation, including but not limited to:
- Falls, terrain, traffic, weather conditions
- Actions of yourself or others
- Lack of supervision or medical support
- Any conditions of roads, trails, or environments you choose
You agree that you are medically able and properly trained to participate and assume full responsibility for your health and safety.
3. Release and Waiver of Liability
To the fullest extent permitted by law, you waive, release, and discharge Gone For a Run (“GFAR”)/ChalkTalk Sports, Inc. (“CTS”), including its parent companies, subsidiaries, affiliates, officers, employees, contractors, agents, and representatives, from any and all claims, liabilities, damages, or causes of action, including those arising from negligence, related to:
- Your participation in the Event
- Preparation for or travel related to the Event
- Any injury, illness, loss, or damage
You understand that you are giving up substantial legal rights, including the right to sue.
4. No Affiliation with Listed Charity
You acknowledge that any charity referenced in connection with this Event is not a sponsor, operator, or partner of the Event, and is not responsible for the Event in any way.
GFAR/CTS may choose to donate a portion of proceeds to the referenced charity, but the charity:
- Does not organize or control the Event
- Has no liability related to the Event
- Is not responsible for participant safety or experience
5. Medical Responsibility
You consent to emergency medical treatment if necessary and agree that you are solely responsible for any medical costs incurred.
6. Indemnification
You agree to indemnify and hold harmless GFAR/CTS from any claims or liabilities arising from your participation or your breach of this Agreement.
7. Personal Responsibility & Conduct
You agree to:
- Follow all applicable laws
- Act responsibly and safely
- Accept full responsibility for your environment and decisions
8. No Refund Policy
All registrations are final. No refunds will be issued, including in the event of cancellation.
9. Personal Property
GFAR/CTS is not responsible for any lost, stolen, or damaged personal property.
10. Use of Likeness
You grant GFAR/CTS the right to use your name, image, video, or likeness for promotional purposes without compensation.
11. Data & Privacy
By registering, you agree that your name and email address will be collected and used only by GFAR/CTS for event-related communication and marketing purposes.
GFAR/CTS will not sell, rent, or share your personal information with any third party, including any charity referenced in connection with this Event.
12. Shipping Disclaimer
You agree that GFAR/CTS is not responsible for shipping delays, carrier issues, loss, theft, or damage once items have been shipped.
13. Governing Law
This Agreement shall be governed by the laws of the State of Connecticut, with exclusive jurisdiction in Fairfield County, Connecticut.
14. Acknowledgment
By registering, you confirm that:
- You have read and understand this Agreement
- You are voluntarily agreeing to its terms
- You understand you are giving up legal rights
