GONE FOR A RUN (“GFAR”)/CHALKTALK SPORTS, INC. (“CTS”) VIRTUAL RACE AGREEMENT AND LIABILITY WAIVER
PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
By registering for this virtual event (the “Event”), you agree to the following:
1. Virtual Event Acknowledgment
You understand that this is a virtual event and that you are solely responsible for choosing the location, route, timing, and conditions under which you participate. GFAR/CTS does not supervise, monitor, or control your participation.
2. Assumption of Risk
You acknowledge that participation in the Event is physically demanding and may involve risks including, but not limited to, discomfort, illness, injury, permanent disability, or death.
You voluntarily assume all risks, known and unknown, associated with your participation, including but not limited to:
- Falls, terrain, traffic, weather conditions
- Actions of yourself or others
- Lack of supervision or medical support
- Any conditions of roads, trails, or environments you choose
You agree that you are medically able and properly trained to participate and assume full responsibility for your health and safety.
3. Release and Waiver of Liability
You hereby waive, release, and discharge Gone For a Run (“GFAR”)/ChalkTalk Sports, Inc. (“CTS”), and any partnering charity, organization, company, foundation, sponsor, or event host, along with their respective affiliates, officers, employees, and agents, from any and all claims, liabilities, damages, or causes of action, including those arising from negligence, related to:
- Your participation in the Event
- Preparation for or travel related to the Event
- Any injury, illness, loss, or damage
You understand that you are giving up substantial legal rights, including the right to sue.
4. Indemnification
You agree to indemnify and hold harmless GFAR/CTS and all partnering organizations from any claims or liabilities resulting from your participation.
5. Medical Responsibility
You consent to emergency medical treatment if necessary and agree that you are solely responsible for any medical costs incurred.
6. Conduct & Responsibility
You agree to:
- Follow all applicable laws
- Act responsibly and safely
- Accept full responsibility for your environment and decisions
7. No Refund Policy
All registrations are final. No refunds will be issued, including in the event of cancellation.
8. Personal Property
GFAR/CTS is not responsible for lost, stolen, or damaged property.
9. Use of Likeness
You grant permission for GFAR/CTS and its partners to use your name, image, or likeness for promotional purposes without compensation.
10. Data Sharing & Privacy
By registering, you agree that your name and email address may be shared with the partnering charity, organization, company, event host, or foundation associated with this Event.
You acknowledge and agree that:
- Your information will be used for event-related communication and marketing purposes
- The partnering organization will not sell your information
- GFAR/CTS does not control how third parties use your data once shared, but requires that it be used in accordance with these terms
11. Shipping Disclaimer
GFAR/CTS is not responsible for shipping delays, loss, theft, or damage once items are shipped.
12. Governing Law
This Agreement shall be governed by the laws of the State of Connecticut, with exclusive jurisdiction in Fairfield County, Connecticut.
13. Acknowledgment
By registering, you confirm that you:
- Have read and understand this Agreement
- Are voluntarily agreeing to participate
- Accept all risks and waive legal claims
